Welcome to Jared Aubel Art. These Terms of Service apply to your use of jaredaubel.com and any purchase made through the website. By visiting the website, creating an account, placing an order, or contacting us through the website, you agree to these Terms.
Please read these Terms carefully before making a purchase.
1. About Jared Aubel Art
Jared Aubel Art sells original artwork, fine art prints, giclées, custom artwork, limited-edition pieces, and related art products. Some items may be one-of-a-kind, limited in availability, or made specifically for a customer.

2. Product Information and Availability
We make reasonable efforts to display artwork, descriptions, dimensions, pricing, and availability as accurately as possible. However, colors may appear differently depending on your screen, device settings, lighting, or display type.
Because many pieces are original, limited, or produced in small quantities, availability may change without notice. Placing an item in your cart does not reserve it. An order is not confirmed until payment has been accepted and the order has been approved for fulfillment.
We reserve the right to correct errors, update product information, cancel an order, or limit quantities at any time, including after an order has been placed.
3. Pricing and Payment
All prices are listed in U.S. dollars unless otherwise stated. Prices may change at any time without notice.
Payment is due at the time of purchase. By submitting payment information, you represent that you are authorized to use the payment method provided and authorize us to charge the full order amount, including applicable taxes, shipping, handling, and any other charges shown at checkout.
4. Order Acceptance
Receiving an order confirmation does not guarantee acceptance of the order. We reserve the right to refuse or cancel any order for reasons including suspected fraud, payment issues, incorrect pricing, product unavailability, shipping restrictions, or errors in the product listing.
If we cancel an order after payment has been collected, we will issue a refund for the canceled portion of the order.
5. Shipping and Delivery
Shipping options, costs, and estimated delivery times may be shown at checkout or provided after purchase depending on the item.
Some artwork may require special packaging, freight shipping, insurance, signature confirmation, or additional handling due to size, value, fragility, or the nature of the piece.
Delivery times are estimates and are not guaranteed unless expressly stated in writing. We are not responsible for delays caused by carriers, weather, customs, incorrect addresses, missed delivery attempts, or circumstances outside our control.
Customers are responsible for providing a complete and accurate shipping address. Additional costs caused by incorrect addresses, failed delivery attempts, refused shipments, or returned packages may be the customer’s responsibility.
6. Risk of Loss
Once an order is delivered to the shipping address provided at checkout, the customer is responsible for the artwork unless the package was damaged in transit and reported according to the Damage During Shipping section below.
For high-value shipments, a signature may be required. If a package is marked delivered by the carrier, we may require the customer to work directly with the carrier to investigate missing packages.
7. Returns and Refunds
Returns and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms by reference.
In general, eligible artwork may be returned within 30 days of delivery if it is unused, undamaged, in its original condition, and returned in the original packaging with all included materials.
Custom commissions, personalized artwork, final-sale items, gift cards, digital products, and items damaged after delivery are not eligible for return unless otherwise required by law.
8. Damage During Shipping
If your order arrives damaged, please contact us as soon as possible at jaredsart@aol.com and include your order number, photos of the damaged item, photos of the packaging, and a brief description of the issue.
Please keep all original packaging, boxes, and packing materials while the issue is being reviewed. These materials may be required for a carrier claim.
Damage claims must be submitted within 7 days of delivery so we can review the issue and work toward a resolution.
9. Custom Artwork and Commissions
Custom artwork, commissioned pieces, personalized work, and made-to-order projects may require separate approval, deposits, timelines, and written terms.
Unless otherwise agreed in writing, deposits and payments for custom or commissioned artwork are non-refundable once work has begun. Custom and commissioned artwork cannot be returned because it is created specifically for the customer.
10. Intellectual Property
All artwork, images, designs, product photos, text, logos, graphics, and other content on the website are owned by Jared Aubel Art or used with permission.
Purchasing artwork gives you ownership of the physical item purchased only. It does not transfer copyright, reproduction rights, licensing rights, commercial rights, or the right to copy, reproduce, distribute, sell, modify, mint, publish, or use the artwork commercially unless those rights are granted in a separate written agreement.
You may not use images from the website for commercial purposes without written permission.
11. Personal Use and Resale
Unless otherwise agreed in writing, purchases are intended for personal collection, display, gifting, or lawful resale of the physical item.
You may not reproduce the artwork, create derivative products, use the artwork for advertising, merchandise, digital assets, NFTs, commercial campaigns, or promotional materials without written permission.
12. Account Information
If you create an account on the website, you are responsible for maintaining the confidentiality of your login information and for all activity under your account.
You agree to provide accurate, current, and complete information when placing an order or contacting us.
13. Promotional Offers
Promotions, discounts, free shipping offers, or special pricing may be changed, suspended, or discontinued at any time. Promotional offers cannot be applied retroactively unless stated otherwise.
14. Prohibited Uses
You agree not to use the website for unlawful, abusive, fraudulent, or harmful activity. This includes attempting to interfere with the website, misuse checkout systems, scrape content, copy images, submit false information, or violate any applicable law.
15. Limitation of Liability
To the fullest extent permitted by law, Jared Aubel Art will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website or purchase of artwork.
Our total liability for any claim related to a purchase will not exceed the amount you paid for the item giving rise to the claim.
Some states do not allow certain limitations of liability, so these limits may not apply to you.
16. No Warranty
Artwork is sold as described. Except as expressly stated in writing, we make no warranties, express or implied, regarding the website, artwork, availability, merchantability, fitness for a particular purpose, or non-infringement.
Nothing in these Terms limits any rights you may have under applicable consumer protection laws.
17. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles, unless another jurisdiction’s laws are required to apply.
18. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last Updated” date. Continued use of the website after changes are posted means you accept the updated Terms.
